Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Shoebox Technologies LLC (“Shoebox,” “we,” “us,” or “our”) governing your use of the Shoebox mobile app and the website at myshoebox.io (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
2. Your Account
You sign in using your mobile phone number and a one-time verification code. You are responsible for keeping access to your phone number and account secure, and for all activity under your account. Let us know promptly at support@myshoebox.io if you believe your account has been compromised.
3. The Service
Shoebox lets you capture photos and videos as “moments,” keep them private, collaborate on them with people you invite, and optionally make a moment public by generating a shareable link. We may add, change, or remove features over time.
4. Subscriptions and Payments
Some features require a paid subscription. Subscriptions are sold and processed by Apple through the App Store and are subject to Apple’s terms. The price and billing period are shown to you before you purchase.
- Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before the period ends.
- Your Apple ID account is charged for renewal within 24 hours before the end of the current period.
- You manage and cancel your subscription in your Apple ID account settings, not within the Shoebox app.
- Except where required by law, payments are non-refundable; refund requests are handled by Apple under its policies.
5. Your Content
You keep all ownership of the photos, videos, and text you add to the Service (“Your Content”). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit Your Content solely to operate and provide the Service to you and the people you share with — for example, storing your videos with our streaming provider and showing a public moment to people who have its link. This license ends when you delete the content or your account, except for content already shared with others or copies retained briefly in backups.
You are responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or any law.
6. Acceptable Use and Zero Tolerance for Objectionable Content
We have zero tolerance for objectionable content and abusive behavior. You agree not to create, upload, share, or make public any content, and not to engage in any conduct, that:
- is unlawful, harassing, threatening, abusive, hateful, or defamatory;
- is sexually explicit, pornographic, or sexualizes minors in any way;
- depicts or promotes violence, self-harm, or illegal activity;
- infringes anyone’s intellectual property, privacy, or other rights;
- impersonates another person, or harasses, bullies, or targets another user; or
- contains malware, or attempts to disrupt, reverse engineer, or gain unauthorized access to the Service.
Reporting and enforcement. You can report objectionable content from within the app. We review reports and act on objectionable content and the users responsible — typically within 24 hours — by removing content and, where warranted, suspending or terminating accounts. We may remove content or terminate accounts at our discretion to enforce these Terms.
7. Invitations and Contacts
If you invite someone to a moment, you confirm you have a relationship with that person that makes the invitation appropriate. Use contacts and invitations only to reach people you actually know.
8. Our Intellectual Property
The Service itself — including the Shoebox name, logo, software, and design — is owned by us and protected by law. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service as permitted here.
9. Termination
You may stop using the Service and delete your account at any time from Settings → Account in the app. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including content licenses already granted, disclaimers, limitations of liability, and dispute terms) will survive.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, and you are responsible for keeping your own copies of content that matters to you.
11. Limitation of Liability
To the fullest extent permitted by law, Shoebox and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.
12. Indemnification
You agree to indemnify and hold harmless Shoebox from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Texas will have jurisdiction over any dispute that is not otherwise resolved, except where applicable law gives you the right to bring a claim elsewhere.
14. Assignment
You may not assign or transfer these Terms. We may assign or transfer these Terms, in whole or in part, to a successor or affiliate — including in connection with a merger, acquisition, financing, or corporate reorganization (such as a change in our legal entity) — without notice to you. These Terms will bind and benefit each party’s permitted successors and assigns.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
16. Apple App Store Terms
The following terms apply because you obtained the Shoebox app through Apple’s App Store:
- These Terms are between you and Shoebox only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app. Shoebox is solely responsible for support, as described in these Terms.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Shoebox’s responsibility.
- Shoebox, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar law.
- Shoebox, not Apple, is responsible for investigating, defending, and resolving any third-party claim that the app or your use of it infringes that third party’s intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
